1. Preamble
This document will not be filed, it will be concluded only in electronic form, it is not considered a written contract, it is written in Hungarian, and it does not refer to a code of conduct. If you have any questions regarding the operation of the webshop, the ordering and delivery process, we are available at the contact details provided.
Scope of these GTC on the Service Provider's website www.focivilag.hu, teremsport.hu** and with domain redirection www.furgenyuszi.hu and covers legal relationships on its subdomains.
**The www.focivilag.hu and the www.teremsport.hu a website of the same website, with a different appearance based on the URLs, therefore operates through the same hosting provider and server. In the following, the terms Website and homepage mean both URLs, and both are subject to the same procedure in reference, regulation and operation, with the exception of the regulation of Cookies (see: point 11). All activities involving the provision of personal data are considered the same for both URLs

2. Interpretive definitions
2.1 These General Terms and Conditions (hereinafter: GTC) the Focivilág Pécs Limited Liability Company (hereinafter: Service provider) by www.focivilag.hu, teremsport.hu, as well as domain redirection to www.furgenyuszi.hu (hereinafter: web store) contains the terms and conditions of electronic commercial services provided through the website, as well as the data protection and management principles for personal data management applied during the services.
2.2 In the course of personal data management carried out by the Service Provider as a data controller, according to these Terms and Conditions, any natural person who visits and uses the Website, who uses services from the Service Provider, who enters into a contract with the Service Provider, or who contacts the Service Provider (hereinafter: Customer). The Service Provider respects the privacy of the Customer, so in particular, it handles (collects, stores or uses) personal data only within the legal framework.

4. Basic provisions

4.2 Purpose of the General Terms and Conditions
It contains the general conditions of the legal relationship between the Service Provider and the Customer entering into a contractual relationship with it, and in relation to the personal data processing carried out using the Webstore, it must provide the relevant user with the information required by law about the circumstances and conditions of personal data processing.
4.3 Copyrights
Site under copyright protection. The use, copying, distribution and transmission of visual and content elements (e.g. fonts, buttons, links, icons, text, images, graphics, logos, etc.) as well as text and image materials on the website and all online, either in part or in whole, is only possible with the prior written consent of Focivilág Pécs Kft.
5. Registration and purchase
5.1 Pre-purchase information

5.2 Description of the Service
The Service Provider provides its Customers with electronic commercial services and services related to the information society. The data controller of personal data collected through any online or offline channel of communication with Customers is the Service Provider, who is also the operator of the Online Store and the provider and seller of the services available on these interfaces.
5.3 Online store registration
Registration is done by creating a user account as follows:
- By filling out the registration form available on the website of the Webstore
- With the "Login with Facebook" function available on the website of the Webstore
In all cases, it is necessary to enter and confirm the email address and password to create a user account. The Service Provider does not check the authenticity of the data provided, this is always the responsibility of the Customer.
5.4 Confirmation of registration
The Service Provider will immediately examine the registrations received and confirm their arrival. The Service Provider reserves the right to reject the received registration without giving reasons. Accepted registrations will be confirmed by e-mail.
The Service Provider assumes no responsibility for incorrectly entered data!
5.5 Purchase
The Customer has 2 options for purchase
1) after registration
It is possible after filling out the registration form available on the website. The user will be notified by e-mail of the fact that the registration form has been accepted, which will only become active after clicking on the sent registration link. Then, after entering the account, it becomes possible to purchase
2) shopping with a Facebook account
After placing the selected product in the basket, you can click on the login with Facebook account button to continue or complete the purchase as indicated above
It is also possible to modify and delete the number of products placed in the basket.
Upon successful order submission, the service provider sends a confirmation by e-mail with the name of the room(s) ordered, its price plus VAT, the total amount plus courier costs, and the user and service provider's details. Payment can be made by advance transfer, bank card or cash on delivery.
5.5.1 Delivery, personal collection
The successfully ordered products are delivered to your home by the MLP or GLS courier service selected during the purchase process, as well as by the Wolt Drive API. According to the contract between Wolt Drive API and Focivilág Pécs Kft., the guidelines for this delivery method are contained in the Wolt Drive API General Terms and Conditions.
Personal pick-up is not possible in our store in Pécs, however, it is possible in our store opened in Budapest, 1097 Könyves Kálmán krt 34
under the following conditions:
- your basket only contains products that are in stock in Budapest
- payment can only be made by bank card/debit card
- in this case, there is no delivery cost
When picking up at the store, you must state the order ID and name, based on which they can release the pre-prepared products.

5.6 Payment
5.6.1 Bank transfer
The Service Provider maintains its bank account with OTP Bank Nyrt. In the case of a bank account transfer, the name of the Customer, the ID of the payer, the amount, date and time of the transaction will be forwarded to OTP Bank Nyrt.
5.6.2 SimplePay bank card payment
Online bank card payments are made through the SimplePay system.
The bank card data will not reach the merchant.
The SimplePay Online Payment System is operated by OTP Mobil Kft. - a member of the OTP Group.
Customers using the SimplePay Online Payment System can use SimplePay to make their purchases simply and securely on the SimplePay interface, which is the payment page of OTP Bank.
The payment process is the same as the payment procedure offered in the framework of similar services of banks.
Keeping in mind the security of the user as a cardholder, SimplePay constantly monitors transactions and provides assistance in preventing unexpected events.
The online store cannot gain insight into the data of the card and the account behind it, and will not receive any information about it.

5.6.3 Support by online payment
Advance payment using the service of the online payment service provider selected by the User in the process of sending the support.
The online payment service is provided by Global Payments. When using the service, the User with bank card or
with Global Payments account can pay.
During the online payment, the User's payment data and bank card data are directly and exclusively sent to Global Payments
Europe s.r.o. (1117 Budapest, Október Huszonharmadika utca 8-10.), as during the payment process you will be redirected to Global
Payments page. Global Payments does not share data with the Service Provider.
Additional conditions for online payment are provided in the contract terms of the payment service provider, which the User can read about the payment

The courier services cooperate in the delivery of the ordered goods based on the contract concluded with the Data Controller. The courier services handle the personal data received in accordance with the data management information available on their website.
5.7 The Customer's right of withdrawal
Within 30 days of receiving the ordered product, the Customer may cancel the purchase without reason and return the product, the purchase price of which will be remitted by the Service Provider to the bank account number specified by the Customer. To do this, you must fill out the Withdrawal Form available on the website. The Service Provider does not check the correctness of the given bank account numbers or the account owner. The return of the product and its cost shall be borne by the Customer.
Exceptions to the above are:
1) the product has been used
2) if the product is damaged
3) for textile products, subsequent labeling and logos at the customer's request
4) in the case of shoes and balls, subsequent inscriptions and logos at the customer's request
and all circumstances not mentioned above that led to a deterioration in quality resulting from improper use of the product.
5) In the case of an individual product order. All products are considered unique products that are manufactured and sold in a unique size or according to individual needs, including especially goal nets, soccer goals, ball catching nets
In the case of redeeming a purchase voucher issued by Focivilág Pécs Kft. in the webshop, after canceling the purchase, we will return a Purchase voucher up to the value of the redeemed vouchers, so the voucher purchase cannot be converted to cash in this case!
6. On the content and performance of the contract
The Service Provider provides consumers with information on the website of the online store, on the products, to facilitate product selection. For this, you use product images and a list of product features. In some cases, it may happen that the user finds incomplete information on products that have been uploaded in the past.

7. Accessory warranty
You can - at your choice - use the following accessory warranty claims:
You can request a repair or replacement, unless the fulfillment of the request you choose is impossible or would involve disproportionate additional costs for the company compared to the fulfillment of another request. If you did not or could not ask for the repair or replacement, you can request a proportional reduction of the compensation or you can repair the defect at the expense of the company, or you can have it repaired by someone else or - in the last case - you can also withdraw from the contract.
You can transfer from your chosen accessory warranty right to another, but you will bear the cost of the transfer, unless it was justified or the company gave a reason for it.
What is the deadline for asserting your warranty claim?
You are obliged to report the error immediately after discovering it, but no later than within two months of discovering the error. At the same time, I would like to draw your attention to the fact that you can no longer assert your accessory warranty rights beyond the two-year limitation period from the completion of the contract.
Who can you enforce your accessory warranty claim against?
You can assert your warranty claim against the company.
What other conditions are there for asserting your accessory warranty rights?
Within six months from the date of delivery, there is no other condition for validating your accessory warranty claim other than reporting the defect, if you prove that the product was provided by the service provider. However, after six months have passed since the performance, you are already obliged to prove that the defect you recognized was already present at the time of performance.
8. Product warranty
What rights do you have based on your product warranty claim?
As a product warranty claim, you can only request the repair or replacement of the defective product.
In which case is the product considered defective?
The product is defective if it does not meet the quality requirements in force at the time it was placed on the market or if it does not have the properties described by the manufacturer.
What is the deadline for asserting your product warranty claim?
You can assert your product warranty claim within two years of the product being placed on the market by the manufacturer. After this deadline, you will lose this right.
Against whom and under what other conditions can you enforce your product warranty claim?
You can only exercise your product warranty claim against the manufacturer or distributor of the movable item. You must prove the defect of the product in the event of a product warranty claim.
In what cases is the manufacturer (distributor) exempt from product warranty obligations?
The manufacturer (distributor) is only released from its product warranty obligation if it can prove that:
- the product was not manufactured or marketed as part of its business activities, or
- according to the state of science and technology, the defect did not exist at the time of marketing

- the defect of the product results from the application of legislation or mandatory official regulations.
It is sufficient for the manufacturer (distributor) to prove one reason for the exemption. Due to the same fault, you cannot assert an accessory warranty claim and a product warranty claim at the same time, parallel to each other. However, if your product warranty claim is successfully asserted, you can assert your accessory warranty claim for the replaced product or repaired part against the manufacturer.
9. Data management
The Service Provider handles the personal data contained in these GTC in particular on the basis of the following legislation:
- CXII of 2011 on the right to information self-determination and freedom of information.

CVIII of 2001 on certain issues of related services. law
- XLVIII of 2008 on the basic conditions and certain limitations of economic advertising activity.

- Recommendations and opinions of the National Data Protection and Freedom of Information Authority.
- In accordance with GDPR regulations and recommendations.
The Service Provider does not sell the Customer's data to third parties. The Customer's personal data shall be used exclusively in accordance with the provisions of these General Terms and Conditions and exclusively for the legitimate and clear purposes indicated here, during the period necessary for their implementation.
The Service Provider places particular emphasis on data protection and the security of data management.
It protects personal data with appropriate measures, in particular against unauthorized access, alteration, transmission, disclosure, deletion or accidental destruction. Databases containing personal data can only be accessed by the Service Provider's employees who are specifically required to do so in order to perform their duties, such as in particular persons employed in their duties related to customer service, troubleshooting, or advocacy.

9.2 Legal basis for data management.
Voluntary contribution. Consent can be withdrawn at any time.
9.3 Scope of processed data
Surname, first name, e-mail address, password, password confirmation, favorite team. If a purchase is made, the range of managed data is supplemented with the data of each purchase, such as date, time, purchased product, value of the purchase, billing address, delivery address.
9.4 Definitions
9.4.1 Customer: any specified natural person identified or identifiable on the basis of personal data who provides personal data to the Service Provider, in particular those who visit and use the Online Store, who use services from the Service Provider, who enter into a contract with the Service Provider, or contact them.
9.4.2 Personal data: any information relating to an identified or identifiable natural person. It is possible to identify the natural person who directly or indirectly

9.4.3 Consent: the voluntary and firm statement of the data subject's wishes, which is based on adequate information, and with which he gives his unequivocal consent to the

organization, storage, transformation or change, query, access, use, transmission, distribution, coordination or connection, restriction, deletion, or
destruction;
9.4.8 Source of personal data

9.4.9 Duration of data management
It lasts until the Customer's consent is withdrawn based on legitimate interest (marketing activity). Withdrawal of consent does not affect the basis of consent prior to withdrawal

9.11 Duration of data management

9.12 Legal basis for data management: The express consent of the concerned volunteer. The Customer can withdraw the consent at any time. Withdrawal of consent does not affect the legality of data processing carried out on the basis of consent prior to withdrawal. The Customer may object to the processing of his personal data as detailed in this point at any time. In this case, the Service Provider will immediately terminate the data management.
9.13 Data of minors
The Service Provider does not intend to collect or manage the personal data of minors under the age of 16. If the minor(s) would still provide their personal data, we ask their parents or legal representatives to inform the Service Provider of the fact that they are a minor and to provide their consent, or to request the deletion of this personal data.
9.14 Scope of processed data: Customer ID, order ID, address, purchased products, name (first name and last name), e-mail address, viewed products, favorite teams, viewed pages.
9.15 Source of personal data: Data provided by the data subject. The Service Provider is not obliged to verify that the consent really came from the Customer. If doubts arise later that the consent did not come from the data subject, the data subject may object to the further processing of his/her data, and in this case the Service Provider will terminate the data processing.
9.16 Duration of data management:
It is valid until the Customer's consent is withdrawn, on the basis of a legitimate interest.
9.17 Newsletters
The purpose of data management is to subscribe to the newsletter and to send e-mail newsletters containing economic advertising to subscribers.
During registration on the Webstore, after completing the purchase, or by directly filling out the newsletter subscription form, the Customer may consent to the Service Provider sending him advertising messages about the Service Provider's activities, services, operation, and the promotion of the Service Provider's services in the form of an e-mail newsletter. The Customer confirms the subscription by clicking on the link in the email sent to the Customer's e-mail account. Such communications may include references to offers, new products or our services.
If the Customer no longer requires such information from us, he has the option to unsubscribe from the newsletter at any time on the Website, and it is also possible to unsubscribe by clicking on a link in the newsletter.
9.17.1 Legal basis for data management:
The consent of the concerned volunteer. The Customer can withdraw the consent at any time. Withdrawal of consent does not affect the actions performed on the basis of consent prior to the withdrawal

9.17.2 Duration of data management:
Valid until the Customer's consent is revoked, on the basis of a legitimate interest.
9.18 Application
In order to expand the customer experience, it is available and can be downloaded from the App Store and the Play store. The Application it can be downloaded for free and it does not contain external promotions, however, it contains its own promotions, e.g. the presentation of the latest products. Equally the Applicationcannot be purchased in , however, in the future there will be promotions that can only beApplicationcan be purchased from
The Application does not manage location, camera image. The Applicationapart from and the associated static elements, we do not store anything on mobile devices.
To register or download, the user must provide the following personal data:
- Surname
- First name
- Email address
- Password
- Password confirmation
Requesting the "recommendation code" is a recommended but not mandatory field
A user who registers on the focivilag.hu site can log in without separate registration. This is also true the other way around, if you have not yet registered on the focivilag.hu site, but in the app, yes, you can still log in on the site. You cannot log in with a Facebook account.
When shopping, users receive points for their profile, which they can redeem for vouchers. They are tied to the point value limits, and can be redeemed in the application, and the coupon codes are only displayed there together with the data of previous online purchases.
Coupons can be validated both online and offline. The given coupons are specifically for users are bound so it is not transferable. Each coupon can be used once.
For all online and offline purchases, users receive points per value limit. In the case of offline, only if they can have the seller scan the qr code, or provide their unique identifier, which is a randomly generated string of characters.
9.19 Unique offers for marketing purposes
The purpose of data management is to analyze customer habits and provide more targeted service. Displaying personalized marketing messages in the Webstore, creating personalized offers based on the Customer's behavior, displaying the Service Provider's own and its partners' business offers on the Webstore's website, and creating remarketing campaigns.
By registering for the Online Store or logging in with Facebook, the Customer can consent to the customer's preferences the Service Provider will analyze it, and then, based on the analysis, the Service Provider will provide personalized offers and create a profile for the Customer on the website of the Online Store, Facebook page, and via the Google search engine. The mentioned procedures do not affect the Customer's right to purchase, nor do they oblige the Customer to make any purchases, and have no consequences. Profiling is done in an automated manner using technical means using the following data of the Customer:
- customer ID
- name
- age
- email address
- purchased products
- viewed products
- product placed on wish list
- product placed in cart
- favorite team
- favorite brand
9.20 The Customer's rights in relation to the Service Provider's data management
The Customer has the right to request from the Service Provider information on personal data relating to him, their correction, deletion or blocking of processing, and he may object to the processing of personal data.
9.21 Right to information: The Customer may at any time request information about the data management carried out by the Service Provider, in particular the purpose of the data management, the legal basis, the processed personal data, or the person of the data processor. In the case of exercising this right, the Customer must specify exactly what he is requesting information about.
9.22 Right to rectification: The Customer may request that inaccurate personal data relating to him be corrected by the Service Provider. In the case of exercising this right, the Customer must specify exactly which personal data is inaccurate and what modification is requested.
9.23 Right to erasure: The Service Provider deletes personal data relating to the Customer at the Customer's request if:
- handling is illegal
- is incomplete or incorrect and this condition cannot be legally remedied, provided that the
deletion is not excluded by law
- the purpose of data management has ceased or the storage of data is defined by law
deadline has expired
- it was ordered by the court or the authority
The Customer's request for deletion may only refer to the deletion of data managed on the basis of the Customer's consent, and it does not affect the range of data affected by mandatory data management ordered by law (e.g. data related to invoicing). In case of exercising this right, the Customer must specify exactly which personal data he requests to be deleted, and for what reason he requests the deletion.
9.24 Right to block: In the following cases, the Customer has the right to request that the Service Provider lock (“block”) the data processing, if the Customer requests it, or if, based on the information available, it can be assumed that deletion would harm the Customer’s legitimate interests. The personal data locked in this way can only be processed as long as the data management purpose that precluded the deletion of the personal data exists. The Service Provider only stores the restricted data, does not collect, transmit, modify, etc. In the case of exercising this right, the Customer must specify exactly which personal data he requests to be restricted and for what reason he requests the restriction.
9.25 Right to protest: The Customer may object to the processing of his personal data if the personal data is used or forwarded for the purpose of obtaining direct business
(e.g. sending out a newsletter). In the event of a protest, the Service Provider terminates the data management and locks the data, as well as notifies of the protest and the measures taken based on it all those to whom the data affected by the protest was forwarded and who are obliged to take measures to enforce the right to protest.
9.26 Rights related to automated decision-making: At the Customer's request, information must be provided about the applied method and its essence, and the Customer must be given the opportunity to express his/her point of view.
9.27 Procedure related to the Service Provider's data management
Requests are received by the Service Provider at the Customer Service contact details.

If the request was submitted electronically by the Customer, the Service Provider will respond to the request electronically. Upon receipt of requests, the Service Provider is entitled to check the identity of the Customer and request certificates.
The Service Provider is obliged to do everything possible to notify data processors and recipients of corrections, deletions and restrictions.
The Service Provider is obliged to provide the information in writing in an understandable form as soon as possible, but no later than 30 days after the submission of the request. If necessary, taking into account the complexity of the application and the number of applications, this deadline can be extended by another 30 days. The Service Provider shall inform the Customer of the extension of the deadline, indicating the reasons for the delay, within 30 days of receipt of the request.
10. Complaint handling
The Customer can send complaints about the service to the following email address of the Service Provider: marketing@
The Service Provider will respond to the complaint within 30 calendar days of its submission at the latest.
When submitting a complaint, we recommend providing the following information: (1) detailed information and related circumstances about the subject of the complaint, the nature of the protested procedure and a detailed description; (2) the Customer's request (3) the Customer's contact information regarding the handling of the complaint. Providing this information facilitates and speeds up the investigation of the complaint for the Service Provider.
10.1 Purpose of data management: The purpose of handling the data provided when using the customer service is to answer, investigate, and handle the complaint or the question asked in the report, as well as to inform the Customer about the substantive response of the Service Provider.
10.2 Legal basis for data management: Ekertv. 13/A. Section (3), in the case of non-consumer complaints, the consent of the data subject, which the Service Provider considers to have been given by the notification, in the case of consumer complaints, regarding the records, the Fgytv. 17/A. § (5), according to which the referred data management is mandatory.
10.3 A Scope of processed data: In case of investigation of complaints made by a person who is considered a customer, the processing of the data listed below - CLV of 1997 on consumer protection. Act (Fgytv.) 17/A. pursuant to § - mandatory, in all other cases voluntary by using the customer service and based on the Customer's voluntary consent:
- the name and address of the person notifying the complaint, as well as the name and address of the person making the complaint
other data provided
- place, time and method of submitting a complaint
- a detailed description of the complaint
- other evidence presented by the complainant, a list of them
- a copy of the response letter sent to the complainant
- complainant's telephone number
10.4 Source of personal data: data provided by the data subject. Providing the above data is mandatory, in the absence of them, the Service Provider cannot handle the complaint.

11. Cookie files
The Web Store uses the technology of accessing and recording information on the Customer's computer or other equipment connected to the network (in particular, using cookie files), in order to make the use of the Web Store as convenient as possible for the Customer, including for statistical purposes and for the purpose of adapting the advertising content presented, including the advertisements of the partners and the Service Provider's advertising clients, to the Customer's interests. During the Customer's visit to the Online Store, the data relating to the visit can be automatically collected in the form of the domain name of the website from which the Customer was redirected to the Online Store's website, the search engine, the type of operating system, the IP address, the Customer's ID, other information that the https
protocol forwards.

In addition, the Service Provider may process operating data or information on the localization of the equipment that is used to access the Online Store.
Cookie files are small textual information sent by the server and stored by the Customer's computer, usually on the central disk of the computer or on the mobile device. It stores the information that the Online Store may need in order to match the access method used by the Customer and to collect statistical data regarding the Online Store about which pages have been visited and which items have been downloaded, as well as data about the Internet service provider, e.g. its domain name or the country of origin of the visiting person, while as a basic principle it does not collect any data on the basis of which it would be possible to identify the Customer, despite the fact that this information may more than once be personal data, i.e. it may enable the assignment of certain forms of behavior to a specific Customer.
The cookie files used in the Webshop are primarily used to adapt its content to the Customer's preferences and to increase the efficiency and personalization of the Internet portal's content.
The cookie files used in the Webshop are not harmful either to the Customer or to the computer/end device he uses, which is why we recommend that you do not turn off their service in your browsers. The Webshop uses two types of cookie files: one-access servers, which are only stored on the Customer's computer or mobile device until the Customer exits the given website or switches off the (search) program, and permanent ones, which remain on the Customer's device for the period specified in the parameters of the cookie files or until they are manually removed from the computer.

The Customer can change the way cookie files are used via the browser, including blocking or deleting cookies from the Webstore (and other Internet portals). The method of deletion differs depending on the browser used. Information on how to remove cookie files can be found on the "Help" page of the selected browser.
Detailed information on the management of cookie files on a mobile phone or other mobile device can be found in the Customer manual/user manual of the given phone or mobile device.
Limiting the use of cookie files on a given device makes it impossible or greatly complicates the proper use of the Webstore, for example, it may make it impossible to maintain the login period.
12. Security devices
The Service Provider uses technical and organizational tools that ensure the security of the processed personal data and the appropriate protection of the category of data covered by protection, in particular it ensures that the data is not transferred to unauthorized persons, is not processed, modified, damaged or destroyed in violation of the applicable laws.
The Service Provider makes the following technical tools available, which prevent the acquisition and modification of Personal Data sent electronically by unauthorized persons, and the securing of the database against access by unauthorized persons:
- SSL certificate on the pages of the Webshop where Customer data is to be entered

- access to the User Account is only possible using an individual login and password

13. Remedy

If the Customer's request is rejected by the Service Provider, the Customer can file a report with the National Data Protection and Freedom of Information Authority or turn to the court of his place of residence. If you do not agree with the Service Provider's decision regarding his protest, or if the Service Provider does not make a decision within the deadline, the Customer may apply to the court of his place of residence or residence within 30 days from the notification of the decision or the last day of the missed deadline.
14. Final provisions
The Webshop may contain links to other Internet sites. The Service Provider recommends its Customers to familiarize themselves with the privacy policy defined there after switching to another page. These GTC apply only to the listed activities of the Service Provider.
The Service Provider reserves the right to modify the ÁFSZ in the future - which may take place for the following important reasons, among others:
- changes in the legislation in force, especially in the fields of Personal Data Protection, telecommunications law, services provided electronically and regulations governing the rights of consumers, which affect the rights and obligations of the Service Provider and the rights and obligations of the Customers
- the development of the functions or the Electronic Services, which is dictated by the progress of Internet technology, including the application/introduction of new technological and technical solutions that affect the GTC area.
Every time the Service Provider publishes the changes in the General Terms and Conditions on the pages of the Web Store. After each modification, a new version of the General Terms and Conditions appears with a new date.
